Who you're contracting with
DailyChinwag is a trading name of DAILYCHINWAG LTD, a company registered in England and Wales, company number 17517430. Registered office: 53 Hartburn Walk, Newcastle upon Tyne, NE3 3YX. You can reach us at hello@dailychinwag.co.uk.
What DailyChinwag is, and isn't
DailyChinwag provides telephone companionship through an automated, computer-generated companion. The companion is a computer, is introduced as one, and will say so if asked.
DailyChinwag is not an emergency, medical, monitoring or personal-alarm service. It works alongside pendant alarms, carers and family, never instead of them. It does not contact emergency services, and it never gives medical, financial or legal advice.
How the service starts
After you subscribe, no calls are made to the person you've signed up until two things have happened: a setup call with you, and a welcome call with them on which they give their own consent, in their own words, which we record. The first month is paid at checkout. If they decline on the welcome call, the subscription is cancelled and that payment is refunded in full. They can stop the calls at any time simply by saying so on a call.
By subscribing you confirm that you may share their details with us for setup, and that they know (or will know before the welcome call) that the calls have been arranged.
Billing, cooling-off, cancellation
Plans are billed monthly in advance, at the price shown. You have a 14-day cooling-off period with a full refund. You can pause calls (billing continues; longer pauses by arrangement) or cancel from your account at any time; on cancellation the service runs to the end of the period you've paid for, and we tell them properly on a call before the calls end. They are never simply stopped without a word.
Gifts are one-off payments, never auto-renewing. Unredeemed gifts are fully refundable for 14 days, and in full if the recipient declines on their welcome call.
If the person receiving calls dies, calls stop immediately on notification and we refund pro-rata from the date of death without being asked.
Calls, recording and safety
Calls are recorded and processed to provide the service: so the companion remembers, so your family updates are accurate, and so wellbeing concerns can be identified. If a call raises a concern, we contact your nominated contacts in the order you agreed. Where we reasonably believe someone may be at risk from one of their contacts, we may withhold information from that contact and involve appropriate statutory services instead.
What we ask of you
Accurate details, honest use, and no attempts to use the companion for anything unlawful or to obtain advice it must not give. We may end the service (with a refund of any unused period) where these terms are broken.
Liability
Wellbeing flags are observations from conversation, made in good faith; they are not monitoring and we cannot guarantee that every concern is detected. Nothing in these terms limits liability that cannot be limited by law. These terms are governed by the law of England and Wales.
